Nova Medical Finance Limited, ("Nova") welcomes you to our Website, (www.novamedical.co.nz). By viewing the pages of our Website, you acknowledge that you have read and accepted these terms and conditions of use.

1. Applications and Privacy

2. All Applications for credit are subject to Nova lending criteria. Applications for credit may also be subject to approval fees.

3. I the user of the Website:

(a) declare the that all information I submit to Nova, either in the application for finance on the Website, (the "Application") or otherwise, is true and correct and that I am over the age of 18 years and I am not an undischarged bankrupt;

(b) authorise Nova to send my Application to any third party; and

(c) agree any such third party may collect from credit reporting agencies, credit providers, my employers/s, accountant/s, or other named person/s or relative/s, such personal, financial and commercial information and references about me as is necessary for the purposes of considering my Application. I agree that Nova may produce this authority to such parties for the purposes of collecting such information.

(d) agree to meet the cost of an independent valuation of any security in support of my Application, such valuation to be obtained by Nova in consequence of this applicant. My solicitor/agent is authorised to accept any notification on my behalf.

3.2 I acknowledge that if Nova arranges for or provides me with finance, then Nova or any other third party finance provider arranged by Nova:

(a) will keep my personal information during the period finance is provided and after repayments of all credit provided;

(b) may collect and monitor personal information about me as is necessary for the administration and protection of such credit; and

3.3 I request Nova and any related finance company to send me details of other products and services from time to time.

3.4 I understand that I have access to my personal information held by Nova or related finance companies and the right to request correction.

3.5 I acknowledge that I am aware that in the event that insufficient personal information is supplied, or the information supplied is not satisfactory to Nova then my Application may not be accepted.

3.6 I acknowledge that the following disclosure polices apply:

(a) Notice of disclosure of information to a credit reporting agency

Nova Medical Finance ("NMF"), or its agent, is allowed to give a credit reporting agency personal information about your credit application. The information, which may be given to an agency, includes;

Identity particulars and the fact that you have applied for credit, and the amount applied for.
The fact that NMF, or its agent, is a current credit provider to you and that credit provided to you by NMF, or its agent, has been otherwise discharged.
Payments that become overdue and for which collection action has commenced and, advice that payments paid are no longer overdue.
In specific circumstances, that in the opinion of NMF, or its agent, you have committed a credit infringement. Additionally, NMF, or its agent, may seek from a credit reporting agency, information about your credit activity or creditworthiness.

(b) Notice of your right to request alteration to information

The information supplied on this application will be kept at the offices of NMF. Under normal circumstances, you have the right to access that information and request alteration to the information should you feel it necessary.

If NMF,or its agent, considers it relevant in assessing an application for personal credit, I/we agree to NMF, or its agent, obtaining a report about my/our credit activities or creditworthiness from a credit reporting agency.

(d) Agreement that nmf may obtain confirmation of employment and residential information

If NMF, or its agent, considers it relevant in assessing an application for personal credit, I/we agree to NMF, or its agent, obtaining a confirmation of my/our employment and/or residential information.

(e) Agreement to nmf, or its agent, seeking from, or giving to other credit providers details about my/our creditworthiness

I/we agree that NMF, or its agent, may give to and seek from any credit providers named in this credit application and any credit providers that may be named in a credit report issued by a credit reporting agency, information about my/our credit arrangements. I/we further authorise said credit providers to supply said information. I/we understand that this information can include any information about my/our creditworthiness, credit standing, credit history or credit capacity that credit providers are allowed to give or receive from each other. I/we understand the information may be used for the following purposes:

To assess my/our application for credit/creditworthiness.
To exchange information with other credit providers as to the status of a loan where I/we am/are in default with other credit providers or to notify other credit providers of a default by me/us.

(f) Agreement to use of information

I/we acknowledge that if NMF, or its agent, provides this loan, NMF, or its agent, may collect and monitor personal information about me/us as is necessary for the administration and protection of any credit provided and may provide any of the information to a third party employed by NMF, or its agent, to assist in enforcement of any agreement between us.
I/we agree that NMF, or its agent, and any of its related companies may use all personal information held about me/us now or in the future to offer me/us further or alternative financial accommodation and to provide me/us with details of other products and services from time to time and for the purposes of considering any future application for finance made by me/us.

3.7 Information transmitted over the Internet is inherently insecure. Once Nova receives any personal information from you, Nova will hold that information securely and will only use it to provide information to you and for statistical purposes. You may access personal information held by Nova by contacting us, and request correction of any errors in that information.

4. False Information

4.1 All online Applications are subject to credit review and verification of information. If it is shown that information has been falsified then Nova may, at its discretion, invoice you for the time involved in reviewing your Application for credit.

5. Intellectual Property

5.1 Nova holds all copyright and other intellectual property rights in the Website and reserves all rights. You may electronically reproduce and store the contents of the Website solely for the purposes of viewing the Website, or saving Website content, for your own personal use. You may not display or distribute the content of any of these pages in public or where the content is accessible to the public, including any reproduction in any form on the Internet, without permission from Nova.

6. Hypertext Linking

6.1 Please do not create a link to any of the pages on this Website without the prior permission of Nova. If you do create a link to any of the pages on our Website, you acknowledge that you are responsible for all direct or indirect consequences of the link, and you indemnify Nova for all loss, damage, liability, costs or expense arising from or in connection with the link.
